The policy: This privacy policy is for this website www.nickrosephotography.com and governs the privacy of its visitors. It explains how we comply with the EU’s GDPR (General Data Protection Regulation) legislation and the DPA (Data Protection Act).
This policy will explain areas of this website that may affect your privacy and personal details, how we process, collect, manage and store those details and how your rights under the GDPR and DPA are adhered to.

CHILDREN’S PRIVACY
This website and Nick Rose Photography does not market to children, nor do I sell products or services for purchase by children. If you are under 18, you may use our site only with consent from a parent or guardian.

Data from these forms is emailed to nick@nickrosephotography.com via the website which is hosted by Squarespace. The privacy policy for Squarespace can be found here: https://www.squarespace.com/privacy/
Backups of website data are held securely on Google Backup and Sync. Direct emails are sent to nick@nickrosephotography.com and emails are hosted by Google.
By completing the online form then you agree to Nick Rose contacting you about your specific enquiry. I will only contact you for these purposes and I do not have any mailing lists or use any studio management software. Your details will not be passed on to any third parties or used for any marketing purposes. Contact form emails will only be stored in my secure email account which can only be accessed by Nick Rose. Should you wish for any emails or details to be removed then please contact me at nick@nickrosephotography.com
EMAIL MARKETING
Nick Rose Photography does not engage in any form of email marketing and you will not receive any emails or telephone calls to market my services. Information gathered from contacting me will never be knowingly passed on to any third parties
CLIENT GALLERIES AND ADDITIONAL SERVICE PROVIDERS
Nick Rose Photography will create an online client gallery for each client as part of the services contracted. These are hosted by Pass and their privacy policy can be viewed here: https://passgallery.com/privacy-policy
As your gallery is created then I will need to provide your email addresses to the gallery host in order for you to receive an access invite for this gallery. To access and download images from a gallery you may be required to enter personal data (namely your email address) and a password. These is also options for you to log in using social media accounts. Prints and products may be ordered directly from a gallery and further details will need to be provided to complete any transactions.
By providing details to access online client galleries then Pass may contact you regarding your gallery and any offers relating to your gallery (such as special offers on prints or gallery expiration dates).
Online galleries created by Nick Rose Photography are kept online for a minimum of 1 year and usually expire after 10 years. I am happy to delete a gallery at any time with a written request sent to nick@nickrosephotography.com
By logging into a Nick Rose Photography client gallery you are agreeing to opt in to receive relevant, gallery-specific emails as described above. Emails are automated so if you do not wish to receive such emails it is advised that you do not log into any of my online client galleries.
As part of my service to you as a client then it may be necessary to provide some of your personal data to selected service providers in order to complete any services agreed. This includes, but is not limited to:
Your email address to my online gallery hosts (as explained above)
Your name and shipping address to companies that produce my wedding albums or print products (in order for them to deliver these to you)
Your email address to any other online delivery methods I may use (if I need to send any images or information to you via Dropbox, Google Drive, WeTransfer etc)
If you order a wedding album or any print products then I will need to provide the relevant companies with a shipping address.
CLIENT DATA HELD BY NICK ROSE PHOTOGRAPHY
As part of the services I provide, the following personal date of clients is held by Nick Rose Photography

Telephone numbers
Event details
These details are held and stored securely in my email account. Soft copies may also be filed securely in my office. Soft copies are also brought to your event as needed (such as a print out of your wedding day timeline for me to refer to on the day.
Client images are safely stored on my password protected computer with backup copies on encrypted hard drives and in the cloud. Cloud backups are stored using Google Backup and Sync.
CLIENTS AND WEDDING GUESTS CAPTURED IN PHOTOS
Under GDPR legislation, a photograph may in some instances constitute a form of personal data where they can be processed to allow “the unique identification or authentication of a natural person”. Nick Rose Photography will never photograph an individual as a means of unique identification or authentication unless consensually contracted to do so. Guests at weddings appear in photos taken by Nick Rose Photography as a part of the visual recording of the event in photos. Guests captured in portraits or in group photos do so as part of the event and their rights are protected by Nick Rose Photography as detailed in this privacy policy.
In terms of explicit GDPR compliance, Wedding clients and guests are photographed within the parameters of GDPR legislation on the basis of ‘legitimate interests’. The taking of photographs of wedding guests when viewed as a form of processing personal data is necessary for the legitimate interests of Nick Rose Photography as a photography business unless there is a good reason to protect a given individual’s personal data which overrides those legitimate interests.
Operating within the parameters of legitimate interests as laid out in GDPR legislation, the disproportionate effort involved in providing privacy policy information to all wedding guests at the event and the degree to which it would distract us from performing our job renders it infeasible to do. Wedding clients are therefore requested in their contract to direct their guests to read this privacy policy in advance of the event and to advise them to contact us in advance with any concerns around the processing of their personal data, namely being photographed.
COMPLAINING
Please send any complaints or data protection enquiries to nick@nickrosephotography.com. Information sent in any request is recorded to resolve any request or complaint. If your request reasonably requires me to contact some other person, I may decide to give to that other person some of the information contained in your complaint.
USE OF IMAGES
Nick Rose Photography may use any photographs to promote my services on the website, social media, any photography related websites or in print. Use of these images will always be lawful and without damage. The rights of people captured in any images used are protected in accordance with the terms of this privacy policy.
